Auction Format & General Information
This is an online, vetted auction jointly
presented by Arte Primitivo and Artemis Fine Arts.
The auction will be conducted
live on the Arte Primitivo website, with simultaneous live bidding mirrored
across additional platforms, including Artemis Fine Arts, LiveAuctioneers,
and Invaluable. We strongly encourage all clients to place their bids
directly through the Arte Primitivo website, where bidding is
fully supported and buyer s premiums may be reduced depending on payment
method.
Unlike traditional Arte Primitivo auctions, in
which lots close individually in a timed sequence, this auction will be conducted live, with lots
closing one after another in real time, as in a traditional live auction.
Each lot is assigned an
estimated value range and a published closing order. Opening bids are generally
set at approximately one-half of the low estimate, though this may vary. The
opening bid constitutes the reserve.
Estimates are provided as a guide only.

Bidding and Registration
Clients may bid directly on the Arte Primitivo website, either by
leaving absentee bids in advance or by participating live during the auction.
Live bidding will occur in real time, and the highest bid received across all
platforms at the moment a lot closes will be
recognized as the winning bid.
While
bidding will be available on other platforms, bidding through Arte Primitivo
offers the most favorable buyer s premium structure and direct client support.
All bidders
must register in advance and be approved to bid. A valid credit card is
required for registration. Invoicing for this auction will be handled by Artemis Fine
Arts, so the credit card on file may not be automatically
charged for your winning bids on Arte Primitivo s
platform.
Buyer s Premium
The standard
buyer s premium for this joint auction is 30%; however, clients bidding
directly through the Arte Primitivo website may qualify for a reduced buyer s premium,
depending on the method of payment:
25% buyer s premium if paying by check, money order, or
bank wire transfer
27.5% buyer s premium if paying via ACH
30% buyer s premium if paying by credit card or PayPal
Bids placed through third-party platforms are subject to
their own terms and will incur a 30% buyer s premium, regardless of payment
method.
3.
Payment, Sales Tax & Shipping
For
this joint auction, invoicing will be handled by Artemis Fine
Arts. Payment is due in full upon receipt of the invoice unless other
arrangements have been made before the auction. Lots will be released for shipment only after payment in full has
been received.
New
York State sales tax and Colorado sales tax will be applied
where required by law, unless the purchaser is tax-exempt and a valid exemption
or resale certificate is on file, or unless the lot qualifies for out-of-state
shipment.
Please
note that purchased items will ship from New York City, New York, or
Louisville, Colorado, depending on the location of the lot. As a courtesy, Arte
Primitivo can assist with arranging shipment for items located in New York
City. All other lots will be shipped by Artemis Fine Arts
in-house shipping
department or, where applicable, through LiveAuctioneers LiveShipping
service.
Shipping
and handling charges are the responsibility of the buyer and will be added to
the invoice or billed separately, as applicable.
4.
Bid Management
This
auction is conducted as a live auction, not a timed/staggered closing sale. Lots will
be offered one at a time and will close sequentially, in real time. You
may contact Arte Primitivo or Artemis before the auction lot s
closing to place new bids, confirm the status of bids already submitted, or
adjust bidding limits if necessary. Incoming bids will be
accepted until the close of each lot. We strongly recommend not waiting
until the final moments to place bids. Any bid written, oral, or
electronic authorizes Arte Primitivo and or Artemis to bid on your behalf up to
the maximum amount specified, but not to advance to your full limit unless
supported by competing bids.
5.
Bidding Increments
The current high bid is
determined by taking the second-highest bid and increasing it by one
bidding increment. Bidding increments are as follows:
Up to $750 $25
$750 to $1,500 $50
$1,500 to $3,000 $100
$3,000 to $7,500 $250
$7,500 to $15,000 $500
Over $15,000 $1,000
Example:
If you place a high bid of $1,000 on a lot with a minimum bid (reserve) of
$500, and the second-highest bid is $525, your bid will appear as the current
high bid at $550. Any subsequent bid below your $1,000 limit will
be automatically exceeded on your behalf.
6.
Authenticity Guarantee & Returns
All lots are
guaranteed genuine, as described both as to condition and
authenticity. Sizes listed are the longest possible measure, excluding
stands or mounts. Mounts are included with lots only when listed in the
descriptions. Any lot may be returned within ten days
if inaccurately described as to age, extent of damage or repair. All returned
lots must be adequately insured against loss or damage
and must be received by us in the same condition as when shipped. Any dispute
as to authenticity, must be made within three months
of the sale date. After that period, all sales will be
considered final. Accurately described lots are not returnable. Any lot
returned after the consignor has been paid (60 days after auction closing date) will be for credit only.
Prompt payment and pick-up is recommended to avoid
late fees and late return situations.
7.
Viewing
The majority of lots will be available for
in-person viewing at Arte Primitivo s NYC gallery,
before the auction. Some lots are located in Colorado and may be available for
viewing by appointment only.
8.
Unsold Lots
May be
re-offered immediately after the auction, and will be sold in the same format
as Arte Primitivo has always conducted its Unsold Lots auctions (timed, not
live). You may offer any bid, as long as it tops the
existing bid, if there is one, by at least $25. The bids will
not be run up incrementally, and your highest offer will be negotiated
with the consignor. If
your offer is the highest received at the close of the lot, we will present it
to the consignor for review. Should the consignor decide not to accept the
offer, the lot will remain unsold. If the offer is accepted, you will receive
an invoice for the accepted bid amount, along with the buyer s premium and any
applicable shipping charges or sales tax.
9.
Auctioneer reserves the right to withdraw any
lot for any reason, prior to the auction closing. We are not responsible for
any typographical errors, either in the
printed or in any of the on-line platforms. In the event of a system,
site or internet failure, the auctioneer reserves the right to postpone any closing/date of
any unsold lots. We will execute absentee bids faithfully and to the best of
our ability, but we assume no responsibility for errors, deletions or
omissions. Any disputed lot may be re-offered or re-opened
for bidding, at the auctioneer s discretion.
